Terms of Service

These Terms of Service ("Terms") govern your use of the AccessComply application ("App") provided by AccessComply ("we," "us," or "our"). By installing or using the App, you agree to these Terms.

1. Service Description

AccessComply is a Shopify application that:

  • Runs supported technical checks for page titles, search descriptions, and page-code speed opportunities
  • Runs automated checks targeting WCAG 2.1 Level AA and applicable WCAG 2.2 Level AA criteria, with EN 301 549 v3.2.1 web-clause mapping based on WCAG 2.1
  • Prepares and applies supported, merchant-approved fixes to theme files and supported editable storefront content
  • Provides separate SEO, speed, and accessibility issues and module scores when measured
  • Monitors your store for new supported issues on the schedule included with your plan
  • Generates automated issue reports, fix records, and accessibility statements

The App uses rule-based SEO and speed checks, automated accessibility tools (including axe-core), rule-based fix workflows, and AI-assisted accessibility workflows to detect and fix supported issues. Theme and storefront-content changes require your explicit approval.

2. Eligibility

You must have an active Shopify store and be authorized to install apps on that store. You must be at least 18 years old or the age of majority in your jurisdiction.

3. Account and Access

By installing the App, you authorize us to access your Shopify store data as described in our Privacy Policy, including theme files, product data, and store information. You are responsible for maintaining the security of your Shopify account.

4. Subscription and Billing

Pricing

The App is available in the following tiers: Free, Starter ($49/month), Shield ($99/month), and Citadel ($399/month). Features available in each tier are described on our App Store listing.

Billing

All charges are processed through Shopify's Billing API. Your subscription charges appear on your Shopify invoice. We do not collect payment information directly.

Cancellation

You may cancel your subscription at any time through the App settings or by uninstalling the App. Cancellation downgrades your store to the Free plan immediately. Shopify handles all refunds and billing adjustments in accordance with its billing policies.

Plan Changes

You may upgrade or downgrade your plan at any time through the App. Upgrades take effect immediately. Downgrades take effect at the start of your next billing period.

5. Theme and Storefront Content Modifications

Your Consent

The App modifies supported Shopify theme files, product content, or page content only when you explicitly approve a fix by clicking "Apply Fix," "Apply All Fixes," or a similar action. Optional Theme App Extension enhancements run only when you enable them in Shopify's theme editor.

Saved Originals

Before a theme-file change, the App saves the affected code. Supported product and page updates record the original editable value. Saved originals are retained for up to 90 days and may be deleted earlier after uninstall or a valid erasure request.

Restore

You may restore supported changes through the App's saved-original and restore functionality while the change record is available. Restores require your explicit confirmation. Before writing, the App compares the current target with the value recorded immediately after the AccessComply change; a target with later conflicting edits is skipped and shown for hands-on review instead of being overwritten. Other independently checked targets in the same restore may still be restored. Review the current storefront and affected resources before confirming a restore.

Theme App Extensions

The optional Theme App Extension provides merchant-selected navigation and presentation enhancements. It does not modify theme files directly and is removed if you uninstall the App. Semantic and content fixes use the approval and restore workflow described above.

6. Compliance Disclaimer

AccessComply is a technical Shopify growth and store-health tool. Its SEO module is not a complete SEO suite, and its speed module does not provide field Core Web Vitals or real-user monitoring. We do not guarantee rankings, traffic, performance scores, conversions, or revenue. Using the App also does not guarantee full compliance with the Americans with Disabilities Act (ADA), the European Accessibility Act (EAA), WCAG 2.1 + 2.2, or any other accessibility standard or law.

  • Automated accessibility scores and issue priorities cover only the pages, states, and rules tested and may not capture all barriers.
  • Automated scanning tools cannot detect all types of accessibility barriers, particularly those requiring human judgment (such as whether alt text is meaningful or content is logically ordered).
  • The App does not provide legal advice. Consult a qualified attorney for legal guidance on accessibility compliance.
  • We do not guarantee that using the App will prevent lawsuits or regulatory action.

7. AI-Generated Content

The App uses AI to generate alt text for images and ARIA labels for interactive elements. AI-generated content may not always be accurate or appropriate. You are responsible for reviewing AI-generated content before approving it for use on your store.

8. Service Availability

We strive to keep the App available and functional at all times, but we do not guarantee uninterrupted service. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Scanning and fix generation depend on access to your Shopify store, which may be affected by Shopify platform issues.

9. Intellectual Property

Our Property

The App, including its code, design, scanning algorithms, fix agents, and documentation, is our intellectual property. Your subscription grants you a license to use the App, not ownership of it.

Your Property

Your theme files, store content, and data remain your property. Approved changes to your theme files or storefront content become part of your store and remain if you uninstall the App (except optional Theme App Extension enhancements, which are removed on uninstall).

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • Our total liability for any claim arising from or related to the App is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not liable for damages resulting from approved changes to your theme or storefront content, including visual changes, broken functionality, inaccurate generated content, or customer complaints. You are responsible for reviewing changes before and after application.
  • We are not liable for any legal claims, lawsuits, or regulatory actions related to your store's accessibility, whether or not you use the App.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your store's content, or your violation of these Terms.

12. Data Handling on Uninstall

When you uninstall the App:

  • We stop all scanning, monitoring, and processing of your store data.
  • Approved changes already applied to theme files or storefront content remain in place.
  • Optional Theme App Extension enhancements are automatically removed by Shopify.
  • Your scan data, issue records, and saved originals are deleted within 30 days of uninstallation.
  • We respond to any Shopify privacy webhooks related to data deletion.

13. Acceptable Use

You agree not to:

  • Use the App to scan stores you do not own or have authorization to manage
  • Attempt to reverse-engineer, decompile, or extract the App's source code or algorithms
  • Use the App in a way that violates Shopify's Terms of Service or Partner Program Agreement
  • Interfere with the App's operation or its infrastructure
  • Resell or redistribute the App's functionality

14. Modifications to Terms

We may update these Terms from time to time. We will post the updated date and provide any additional notice required by applicable law. Continued use after the effective date constitutes acceptance where permitted by law.

15. Termination

We may suspend or terminate your access to the App if you violate these Terms or if required by Shopify. You may terminate your use at any time by uninstalling the App.

16. Governing Law

These Terms are governed by the laws applicable to the operating entity that provides AccessComply, without overriding mandatory consumer or merchant protections. Jurisdiction and venue are determined under applicable law. Contact us for the current contracting-entity details before purchase if needed for procurement.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
