Terms of Service

These Terms of Service ("Terms") govern your use of the AccessComply application ("App") provided by AccessComply ("we," "us," or "our"). By installing or using the App, you agree to these Terms.

1. Service Description

AccessComply is a Shopify application that:

  • Scans your Shopify store pages for web accessibility violations based on WCAG 2.1 Level AA standards
  • Generates and applies accessibility fixes to your theme files
  • Provides compliance scoring, risk assessments, and violation reports
  • Monitors your store for new accessibility violations
  • Generates compliance reports and accessibility statements

The App uses automated scanning tools (axe-core) and AI-powered agents to detect and fix accessibility issues. Fixes are applied to your theme files only with your explicit approval.

2. Eligibility

You must have an active Shopify store and be authorized to install apps on that store. You must be at least 18 years old or the age of majority in your jurisdiction.

3. Account and Access

By installing the App, you authorize us to access your Shopify store data as described in our Privacy Policy, including theme files, product data, and store information. You are responsible for maintaining the security of your Shopify account.

4. Subscription and Billing

Pricing

The App is available in the following tiers: Free, Starter ($49/month), Shield ($99/month), Fortress ($199/month), and Citadel ($399/month). Features available in each tier are described on our App Store listing.

Billing

All charges are processed through Shopify's Billing API. Your subscription charges appear on your Shopify invoice. We do not collect payment information directly.

Cancellation

You may cancel your subscription at any time through the App settings or by uninstalling the App. Cancellation takes effect at the end of your current billing period. Shopify handles all refunds in accordance with their billing policies.

Plan Changes

You may upgrade or downgrade your plan at any time through the App. Upgrades take effect immediately. Downgrades take effect at the start of your next billing period.

5. Theme Modifications

Your Consent

The App modifies your Shopify theme files only when you explicitly approve a fix by clicking "Apply Fix," "Apply All Fixes," or similar action buttons. We never modify theme files without your direct action.

Backups

Before applying any fix, the App creates a backup of the affected theme files. Backups are retained for 90 days and can be used to restore your theme to its pre-fix state.

Rollback

You may roll back any applied fix through the App's backup and restore functionality. We recommend reviewing your store after applying fixes to confirm they appear as expected.

Theme App Extensions

Some fixes are delivered through Shopify Theme App Extensions (CSS and JavaScript injections). These do not modify your theme files directly and are automatically removed if you uninstall the App.

6. Compliance Disclaimer

AccessComply is a tool to help improve your store's web accessibility. Using the App does not guarantee full compliance with the Americans with Disabilities Act (ADA), the European Accessibility Act (EAA), WCAG 2.1, or any other accessibility standard or law.

  • Compliance scores and risk assessments are based on automated scanning and may not capture all accessibility issues.
  • Automated scanning tools cannot detect all types of accessibility barriers, particularly those requiring human judgment (such as whether alt text is meaningful or content is logically ordered).
  • The App does not provide legal advice. Consult a qualified attorney for legal guidance on accessibility compliance.
  • We do not guarantee that using the App will prevent lawsuits or regulatory action.

7. AI-Generated Content

The App uses AI to generate alt text for images and ARIA labels for interactive elements. AI-generated content may not always be accurate or appropriate. You are responsible for reviewing AI-generated content before approving it for use on your store.

8. Service Availability

We strive to keep the App available and functional at all times, but we do not guarantee uninterrupted service. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Scanning and fix generation depend on access to your Shopify store, which may be affected by Shopify platform issues.

9. Intellectual Property

Our Property

The App, including its code, design, scanning algorithms, fix agents, and documentation, is our intellectual property. Your subscription grants you a license to use the App, not ownership of it.

Your Property

Your theme files, store content, and data remain your property. Fixes applied to your theme files become part of your theme and remain even if you uninstall the App (except for Theme App Extension injections, which are removed on uninstall).

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • Our total liability for any claim arising from or related to the App is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not liable for any damages resulting from accessibility fixes applied to your theme, including visual changes, broken functionality, or customer complaints. You are responsible for reviewing fixes before and after application.
  • We are not liable for any legal claims, lawsuits, or regulatory actions related to your store's accessibility, whether or not you use the App.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your store's content, or your violation of these Terms.

12. Data Handling on Uninstall

When you uninstall the App:

  • We stop all scanning, monitoring, and processing of your store data.
  • Fixes already applied to your theme files remain in place (they are part of your theme code).
  • Theme App Extension injections (CSS/JS fixes) are automatically removed by Shopify.
  • Your scan data, violation records, and backups are deleted within 30 days of uninstallation.
  • We respond to any Shopify privacy webhooks related to data deletion.

13. Acceptable Use

You agree not to:

  • Use the App to scan stores you do not own or have authorization to manage
  • Attempt to reverse-engineer, decompile, or extract the App's source code or algorithms
  • Use the App in a way that violates Shopify's Terms of Service or Partner Program Agreement
  • Interfere with the App's operation or its infrastructure
  • Resell or redistribute the App's functionality

14. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the App at least 30 days before changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Termination

We may suspend or terminate your access to the App if you violate these Terms or if required by Shopify. You may terminate your use at any time by uninstalling the App.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App will be resolved in the courts of Delaware.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
